Use and Disclaimer

By entering the public access section of the ICE Index Platform ("IIP") you acknowledge and agree that your use of the IIP and receipt of ICE Data Indices, LLC ("ICE Data") index data and information is subject to the following: (i) the index data and information is for informational purposes only and any use is expressly prohibited; (ii) you may not share, disclose, transmit, publish, distribute, disseminate, or commercialize, either in whole or in part, either directly or indirectly through any third parties, the index data or information contained herein to any person or entity without the prior express written consent of ICE Data; (iii) the index data and information contained herein constitutes confidential and proprietary information and valuable property owned by ICE Data, its affiliates and/or their respective third party suppliers (the "ICE Group"); and (iv) your use of any non-public section of the IIP or use of the index data or information in any way will require an appropriate ICE Data license agreement prior to such use.

The ESG-related information, methodologies, data and opinions contained or reflected herein are not directed to or intended for use or distribution to India-based clients or users and their distribution to Indian resident individuals or entities is not permitted, and Morningstar Sustainalytics accepts no responsibility or liability whatsoever for the actions of third parties in this respect.

THE ICE GROUP DISCLAIMS ANY AND ALL WARRANTIES AND REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE WITH REGARD TO THE IIP, INDEX DATA OR INFORMATION AND ANY DATA INCLUDED THEREOF. THE IIP, INDEX DATA AND INFORMATION AND ALL COMPONENTS THEREOF ARE PROVIDED ON AN "AS IS" BASIS AND USE IS AT YOUR OWN RISK.

THE ICE GROUP SHALL NOT BE SUBJECT TO ANY DAMAGES OR LIABILITY WITH RESPECT TO THE ADEQUACY, ACCURACY, CORRECTNESS, TIMELINESS OR COMPLETENESS, RELIABILITY OR OTHERWISE OF THE IIP, INDEX DATA OR INFORMATION. THE ICE GROUP DOES NOT WARRANT THAT THE ACCESS TO THE IIP, INDEX DATA OR INFORMATION WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE IIP, INDEX DATA OR INFORMATION ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. IN NO EVENT SHALL THE ICE GROUP AND THEIR RESPECTIVE OFFICERS, DIRECTORS AND EMPLOYEES HAVE ANY LIABILITY TO YOU FOR ANY DIRECT, SPECIAL, PUNITIVE, INDIRECT, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS), EVEN IF NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGES.
